Appointments of Enduring Guardian.

An appointment of Enduring Guardian is a powerful legal document that gives someone the authority to make medical and other personal or lifestyle decisions for you if you do not have the capacity to make those decisions for yourself due to accident or illness.

The types of decisions an Enduring Guardian might need to make for you can include:

  • where you may live,

  • the services you need,

  • what health care you receive or

  • consenting to medical and dental treatment on your behalf.

An Enduring Guardian’s powers only come into effect when you lose the capacity to make those decisions yourself, and remain in effect while you lack capacity to make decisions for yourself. The enduring nature of the guardian’s authority continues while you are incapacitated.

Every person over the age of 18 should appoint a guardian to make medical and personal decisions for them in the event that they cannot make those decisions for themselves.
